West Virginia IWW Commemorates Battle of Blair Mountain Centennial

Over Labor Day weekend, a series of events were held in West Virginia to commemorate the centennial of the “Battle of Blair Mountain,” the largest labor uprising in the history of the United States, which pitted local mine workers against mine owners, law enforcement, and even the US military in 1921. The commemoration was sponsored in part by the Industrial Workers of the World branch in West Virginia.

According to the Blair Centennial Project, the main organizer of the events, the aim of the commemoration was to “memorialize the brave men and women who fought for the civil rights of miners and their families” and to “celebrate the spirit of Blair Mountain that was passed on to us today.”

The centennial’s kickoff was held on Friday, September 3, and tabled by sponsors, including the West Virginia IWW. The event featured West Virginians speaking about their families’ connections to the Battle of Blair Mountain and the larger series of conflicts between mine workers and mine owners throughout the United States, known as the Mine Wars.

“One of the women, Wilma Steele, on the board for the West Virginia Mine Wars Museum, went to high school in Matewan, West Virginia, and didn’t learn an ounce about the history of the Mine Wars until she married into the United Mine Workers of America,” says Jonah Kone, a member of the West Virginia IWW. “They just don’t teach it in school here, and that’s intentional.”

The kickoff also featured other performers, centering around a concert of traditional Appalachian music.

The following day, organizers held a series of historical and artistic events. The day began with an event hosted by the West Virginia Association of Museums to consider the issue of museum neutrality in circumstances of historical injustice. There was also an IWW-themed event where union songs were played, along with recognition of recent IWW organizing campaigns in the area, such as at Coal River Mountain Watch.

Another event, entitled “The People’s Church,” was organized by a pastor whose goal is to bring back “Holler Gospel,” a form of religious observance that was once popular in the area. During the period of the Battle of Blair Mountain, much union support came from religious quarters, who used the Bible as justification for the labor movement and in direct defiance of “company churches.” Miners attended Holler Gospel services during lunch breaks and even signed union cards during religious events.

Although the Battle of Blair Mountain Centennial was meant to be commemorative, there was also a feeling of relevance for the future — that the events were more than just rumination on history.

“This event will serve as a catalyst for things to start happening one or two years from now,” says Kone. “There’s a lot of labor organizing happening within the United States.”

Voodoo Employees Wrongly Fired During June Heat Wave, Labor Board Rules

The fired employees will get their jobs back and receive back pay for the three months they were unemployed at the Old Town doughnut shop.

Seven Voodoo Doughnut employees who were fired after walking off the job during the record-breaking June heat wave were wrongly terminated, the National Labor Relations Board ruled on Oct. 6.

The board ordered that Voodoo rehire the employees and offer back pay for the more than three months they weren’t employed at the Old Town doughnut shop.

Voodoo Doughnut’s corporate office did not respond to a request for comment.

A majority of the Old Town location’s employees walked out of the shop during the 116-degree heat wave that blanketed Portland in late June. Employees at the time told WW that temperatures inside the shop swelled to even higher than the outside temperature, and that the presence of deep fryers exacerbated the stifling heat.

“Attempts to provide relief, such as Gatorade and wet towels, are insufficient and the current air-conditioning system is not up to the task of dealing with this heat wave,” a Doughnut Workers United representative said at the time. “No person should work in temperatures in excess of 90 degrees. Other establishments have taken the reasonable step of closing during this time while Voodoo Doughnut, with its large southwest-facing windows and deep fryers, has not.”

After walking out, seven employees were fired on the allegation of workplace abandonment.

The National Labor Relations Board also deemed that the company partook in inappropriate conduct by surveying its employees’ support for a union drive.

Workers at Curbside Recycling Win Raise, Paid Time Off

For workers at the Curbside Recycling Program in Berkeley, California, the ongoing COVID-19 pandemic highlighted the need for better working conditions. The truck drivers, who have been required to work every day while many California residents sheltered at home, demanded and won both a wage increase and more paid time off. The Curbside Recycling Union is organized with the Industrial Workers of the World.

The Curbside Recycling Program is operated by the Ecology Center, a nonprofit organization, under contract with the City of Berkeley. The program’s recycling truck drivers began organizing in 1988 and won their first union contract the following year. More than 30 years later, the drivers remain unionized, winning greater wages and benefits, as well as maintaining control over their routes and accident review committees.

“The purpose of the accident review committee is to give the workers the ability to discuss and vote on accident responsibility,” explains Joe, a driver at the Curbside Recycling Program and member of the union. “For instance, if a recycling truck is sideswiped by an impatient motorist, the committee has the ability to find the driver of the truck blameless.”

Joe also recalls a half-day strike that the Curbside Recycling Union staged a few years ago, which involved every driver walking off the job.

 “There was one key demand,” says Joe. “That demand was that the workers have a say in route distribution and route assignments, which the company agreed to. … That was a key moment for the union to demonstrate union power.”

Staff at Anti-Mountaintop Removal Nonprofit Coal River Mountain Watch Unionize with IWW

Workers fighting destruction of communities & environment by mountaintop removal mining in WV join expanding non-profit labor union

NAOMA, West Virginia — The Industrial Workers of the World (IWW) is excited to announce that workers at the Coal River Mountain Watch (CRMW) have organized with unanimous support under the banner of the IWW.

As of September 7, the IWW has asked for and received voluntary recognition from CRMW management.

Employees at CRMW join their colleagues at Holler Health Justice and the Ohio Valley Environmental Coalition in the widening slate of nonprofits unionized with the IWWs West Virginia Branch.

Coal River Mountain Watch is a grassroots organization created in 1998 in response to the fear and frustration of people living near or downstream from enormous mountaintop removal sites. From humble beginnings as a small group of volunteers working to organize Southern WV residents to fight for social, economic, and environmental justice, CRMW become a major force in opposition to mountaintop removal.

As an organization that stands for human rights in mountain communities and against community destruction by the coal industry – in recognizing their staff’s union – the CRMW can now proudly boast that their values align with their practice.

“I’m beyond proud to be in a union now, and I’m beyond proud to work for an organization that values my rights as a worker,” said Coal River Mountain Watch staff member Junior Walk, adding “Here’s to a brighter future for West Virginia and the brave souls who try to make it a better place to live.”

Food-service workers are suffering from extreme heat; Few rules exist to protect them

With record-breaking temperatures blanketing the country and no federal heat standard in place, workers find they have no choice but to walk out.

As a heat dome blanketed Portland, Oregon in late June, workers at Voodoo Doughnut’s Old Town location found themselves crumbling in their store. Even with air-conditioning in the shop, ambient thermometers brought in by staff recorded interior temperatures upward of 96 degrees. Workers were breaking out in heat hives and doubling over from nausea. The company’s iconic Bacon Maple Bar doughnuts, with their frosting unable to set due to the heat, literally melted into soggy brown mush.

The high-90 temperatures in the Old Town location were already a drastic surge from the more routine ambient summer heat, which was estimated to be around 80 degrees in the store, even with the fryers running all day. But on June 27, when temperature highs in Portland would eventually reach a record-breaking 112 degrees, it reached more than 100 degrees inside Voodoo Doughnut. Workers went to management and suggested that they close the shop early for their safety. After their demand was waved off, a group of employees walked out and went on strike through Monday, when the city’s temperatures soared even further to 115 degrees

“We would rather walk out on strike than to see a coworker collapse and hurt themselves or suffer heat stroke or worst case scenario, you collapse while you’re over a fryer,” said Samantha Bryce, a Voodoo Doughnut employee in Portland, who participated in a strike with her colleagues over workplace safety in June. “We don’t want someone to get hurt before the company takes action.”

One Million Rounds: The Battle of Blair Mountain

When you think of violent labor disputes, which come to mind? For some, it may be the infamous 1886 Haymarket Affair, 1912 Lawrence textile strike (famously known as Bread & Roses), 1894 Pullman Strike, or something as modern as the 1991 Justice for Janitors police riot. But not many will recall the Battle of Blair Mountain, a week-long civil war that took place in West Virginia during the late summer of 1921. Some 13,000 mineworkers took on 3,000 law enforcement officials, military personnel, and the usual local scabs. Rather than take oppression sitting down, these miners put on their hard hats and geared up for war. However, despite the numbers, the miners suffered a crushing defeat and what resulted was the near collapse of the United Mineworkers of America. But how did it all begin?

In the spring of 1912, West Virginian mineworkers, who all lived in small towns near their respective coal fields, attempted to negotiate contracts with the mining companies to give them higher pay raises and union dues that would be automatic. As you might expect, negotiations fell through, resulting in 7,500 workers going on strike throughout West Virginia. Even local supporters who were not mineworkers joined in. This caught the unwanted attention of the Baldwin-Felts Detective Agency, a private police force that was called to the task of using brutality, fear, and intimidation to break up strikes. To really send the message, the agents began evicting miners from their homes, for unionizing with the UMWA.

Eventually, Mary Harris “Mother” Jones, co-founder of the revolutionary Industrial Workers of the World, joined the strikers, but was later arrested for her involvement in the Paint Creek-Cabin Creek strike of 1912. In the early months of the year-long said strike, the miners issued their own declaration of war against the West Virginian government. Several instances of guerilla-style conflicts began to explode in Kanawha County, WV. Things got so bad that WV Governor William E. Glasscock placed the region under martial law. After a year of bloody combat, more than 50 people were reported dead. The Paint Creek-Creek Cabin strike was the beginning of a 9-year labor conflict, now famously referred to as the West Virginia Mine Wars.

Fast-forward to 1920. The Baldwin-Felts agents were at it again, ransacking homes and evicting miners and their families at the Pocahontas Coalfield in the town of Matewan in Mingo County, West Virginia. This time around, they came face to face with Sid Hatfield, the Matewan police chief and beloved labor organizer. Unlike the vast majority of cops in West Virginia, Chief Hatfield was very outspokenly pro-union, using his position of authority to protect striking workers. He confronted the Baldwin-Felts agents and threatened to arrest them, prompting the agents to brag about their own arrest warrants against Hatfield.

Over the years, the circumstances of what happened next have been debated, but according to official court transcripts published in David Alan Corbin’s Gun Thugs, Rednecks & Radicals: A Documentary History of the West Virginia Mine Wars, an eyewitness testified that Cabell Testerman, the mayor of Matewan, said outright that the detectives’ warrants were “bogus,” triggering an angry Albert Felts, one of the heads of the Baldwin-Felts agency, to pull a firearm from his briefcase and shoot the mayor, who died of his wounds minutes later. Immediately after, Hatfield began firing, and a firefight between him and the agents ensued. When the dust settled, one miner, an innocent bystander, seven Baldwin-Felts agents and Mayor Testerman lay dead, while several other townsfolk were wounded in the crossfire.

Coal River Mountain Watch Workers Anticipate Union Recognition

In late July, workers at Coal River Mountain Watch in Naoma, West Virginia, requested voluntary union recognition from the environmental nonprofit organization’s board of directors. They anticipate full recognition of the Coal River Mountain Watch Union, organized with the Industrial Workers of the World, by month’s end.

The campaign to unionize CRMW is being led by Junior Walker, a longtime employee. CRMW workers had considered forming a union previously, but only committed after witnessing the campaign at another West Virginia-based environmental nonprofit, the Ohio Valley Environmental Coalition, which is also organized with the IWW. Workers at OVEC, a larger nonprofit that has collaborated with CRMW in the past, faced significant resistance to union recognition from both management and their board of directors. Walker began speaking with the West Virginia branch of the IWW, which is supporting both campaigns, about unionizing CRMW in solidarity in March. 

Last month, CRMW workers submitted their request for voluntary union recognition to management with no resistance. Workers are now awaiting formal consent from the board of directors, who meet only every few months, thereby slowing the process. Regardless, Walker says that workers have received every indication that the CRMW Union will be recognized by the end of August.

Walker emphasizes that managers at CRMW are “about as good as they come.” Workers are seeking the right of union representation to preserve their current working conditions and, as mentioned, to express solidarity with organizing efforts at allied organizations, like OVEC.

On a personal level, Walker describes the CRMW Union as carrying on a family legacy. His grandfather was a longtime member of the United Mine Workers of America and went on strike against Massey Energy, the first non-union coal company in the area, in the 1980s. Massey was also the parent company of a subsidiary that is now seeking a permit for mountaintop removal mining, which CRMW opposes due to its devastation of mountainside biodiversity and release of carcinogenic blasting dust.

“The fact that I now have a union card in my pocket makes me really proud,” says Walker. “This is the first time I’ve been in a union in my life.”

Long Hours, Sleepless Nights: Nonprofit Workers Unionize in the Appalachian Coalfields

Nonprofit workers can be a self-abnegating bunch. As a sector tasked with solving the world’s ills in ways the state can’t or won’t, from filling gaps in social services and campaigning for environmental justice to running charities and educational programs to ostensibly end poverty, nonprofits can induce in their workers a sense of moral obligation not to complain. After all, almost everyone else is worse off, right? 

That sense of obligation kept the staff of one West Virginia environmental nonprofit quiet for many years. As paid community organizers for the Ohio Valley Environmental Coalition (OVEC), their principal duty was to organizational members, with whom they fought against mountaintop removal coal mining, natural gas development, and petrochemical buildout through lobbying, direct action, and sustained campaign work. In coalitions such as the Alliance for Appalachia and Reimagine Appalachia, OVEC organizers have contributed to policy proposals and lobbying efforts designed to bring the region an explicitly pro-labor, ecologically sustainable economic transition away from coal.

When he was hired, Dustin White was thrilled to be able to dedicate his life to the fight against strip mining, and like many organizers, built a deep and complex network of relationships in communities like the one that raised him. But, he says, paid organizing is time-consuming, travel-intensive, and deeply emotional work, and he found it draining to a degree he felt management simply didn’t understand. 

“Self care ended up being work, too,” said White. As a result of long-term issues with burnout, he and others on staff privately reached out to the Industrial Workers of the World (IWW) in the winter, and hoped to go public on Earth Day. 

“I have had long work hours, sleepless nights, countless hours on the road, hundreds of blisters on my feet, and more during my time with OVEC,” White wrote in a letter to the staff and board. “Time after time I have been told that we trust and support each other and our board of directors would always have our back.” 

A staff member spilled the beans early, though. According to White, management was incensed, and after months of vitriol he and fellow staffer Brendan Muckian Bates were fired. White was fired allegedly for violating the organizational handbook’s civility rules, and Bates for organizing as a manager. Both were prominent in the union effort, though, and believe management’s goal was to discourage others involved in the unionization effort. White had experienced a series of health problems; Bates was a new father. But the lesson from this historically pro-labor organization was this: unions are great for coal miners, but you don’t need one. You have it easy. 

Voodoo Doughnut Workers Hold National Day of Action

Our changing climate is increasingly becoming a workplace issue. because these workers engaged in strike action to protest being forced to work in the extreme heat which hit the Pacific Northwest in Summer of 2021, as this article details:

Workers at Voodoo Doughnut in Portland held a national day of action on July 29 to protest against the allegedly illegal firing of staff and to demand better working conditions. The workers, unionized as Doughnut Workers United with the Industrial Workers of the World, were supported by IWW branches in Portland, Eugene, Austin, Houston, Orlando and Los Angeles, who organized actions outside of local outlets of the Portland-based doughnut chain.

The workplace organizing campaign at Voodoo Doughnut goes back several years. Workers tell Mark Medina, an organizer with the Portland IWW who is supporting the campaign, that they earn minimum wage, receive little respect from management, and feel they are at all times close to being demoted or let go altogether. They have also complained of being harassed and even assaulted when leaving the store. During one robbery, an assailant jumped over the counter and threatened staff with a hatchet. Despite the danger, management refused to hire security until pressured to do so by the union.

The ongoing COVID-19 pandemic further deteriorated working conditions at Voodoo Doughnut. Forty workers were initially laid off, with only three being reinstated. Workers allege that management chose to rehire the minimum number of workers necessary for the company to qualify for pandemic-related relief funds from the federal government and that pro-union workers were intentionally excluded. Workers have also had to procure their own personal protective equipment, which management inexplicably asked them to discard, promising replacements but never delivering.

More recently, workers at Voodoo Doughnut were forced to contend with a heatwave that swept through the region from late June to mid July. Management refused workers’ request to close the shop due to inadequate climate control, forcing them to stage a two walk-out involving nearly the entire staff.

Hoping to address these grievances, Voodoo Doughnut workers organized the recent national day of action across six US cities. Workers have asked supporters to amplify this effort across social media and to contribute to a strike and hardship fund organized by the union. Together, Medina believes that workers and their supporters can show management that the union means business.

“We outnumber them,” he says.

Solidarity with NHS workers from Earth Strike UK

Earth Strike is a grassroots movement for workers, youth, and community organisers to challenge the root causes of the climate crisis. Our mission is to disrupt the capitalist system that is causing the climate crisis and to fight for a better future for the global working class.

We extend our solidarity to, and practical support in, your struggle for pay rises of at least 15%. We will support you on any potential picket lines. Workers fighting for decent pay and to protect the standards of our healthcare system should be able to take direct action in pursuit of these demands at a time and in a manner of their own choosing. We therefore oppose all legal restrictions on the right to strike.

We are environmentalists supporting and seeking to mobilise for your struggle, and we want to see other environmentalists do the same. Our struggles are much closer than many might imagine. Healthcare jobs are climate jobs, and the refusal to fund and support healthcare properly is a damning indictment of this system’s response to climate breakdown. As air pollution chokes children in the streets of London, disproportionately in working-class and black and brown communities, the hospitals which should mitigate the damage are underfunded, with workers in them underpaid and overworked. As the effects of climate breakdown worsen, it will be healthcare systems having to deal with the impact. Meanwhile, we do not forget the vast wealth inequalities that exist between this country and others, particularly where climate destruction is already felt hardest.

As climate activists, we particularly oppose the ban on strikes over so-called “political” issues, and the ban on strikes in solidarity with other workers. Those laws prevent workers from striking directly to demand radical action on climate change, to oppose NHS privatisation and cuts, and to directly support your demands – as miners, postal workers, dockers, print workers, and others did in the 1980s. Our new “Empower the Unions” initiative aims to highlight the injustice of these restrictive laws, and mobilise both climate and trade union activists against them.

So we say: all power to the NHS workers! Your fight for 15% is a key part of the wider struggle for a genuinely socialised healthcare system, free at the point of use and run by workers and service users, which in turn is part of the struggle for a different kind of society – one in which human and environmental need, rather than the needs of profit, comes first.

An injury to one is an injury to all – solidarity!
