Alabama Miners Are Still on Strike After 8 Months

Last week, more than 500 coal mine workers picketed in New York City, joined by a diverse army of other labor movement members and supporters. The mine workers, who extract coal for steel production, are now in the eighth month of their strike against Warrior Met Coal in Brookwood, Alabama. Their aim is to force Warrior Met to restore the pay, benefits, and schedules they had before their previous employer, Walter Energy, declared bankruptcy and auctioned off its assets in 2016.

On Thursday, the mine workers marched to the headquarters of BlackRock, the world’s largest asset manager and Warrior Met’s biggest shareholder. After the rally, five United Mine Workers of America (UMWA) members and the union’s president, Cecil Roberts, sat down in the street and refused to move. The six were handcuffed by the New York Police Department and arrested for their act of civil disobedience.

The striking workers brought their picket to the middle of Manhattan because they have been barred from gathering outside the Brookwood mines. On October 27, a Tuscaloosa County circuit judge issued a temporary restraining order stopping all UMWA picket activity at Warrior Met. The injunction, which has been extended through November 15, blocks strikers from gathering within 300 yards of any mine entrance or exit.

That’s a huge restriction. As Haeden Wright, president of the UMWA auxiliary for two of the striking locals, explained to Jacobin, moving the pickets three football fields back from the mines “could put you on a completely separate road from Warrior Met property.” In in an interview with Jacobin, labor scholar Steve Striffler called the restraining order “an unconstitutional act that effectively takes away the miners’ right to free speech and assembly at the conflict’s most important sites.”

The injunction is the apparent product of an aggressive campaign by Warrior Met to spread the misleading narrative that UMWA members are engaging in violence and vandalism on the picket lines. Labor journalist Kim Kelly reported that Warrior Met hired the public relations firm Sitrick and Company to “neutralize the opposition” and “reframe the debate” around a strike that has garnered local and national support despite embarrassingly insufficient coverage from the corporate media.

Cobalt is everywhere. It is a silvery-blue mineral used in the rechargeable batteries that power our mobile phones, laptops and tablets, and in larger quantities, the electric vehicles that will soon dominate our roads. It is a strategic mineral in the plan to decarbonise and move away from fossil fuels towards renewable energy. Accelerating this switch is one of the priorities to tackle the climate crisis and industry experts forecast that electric vehicle sales will skyrocket in the next 10 years. This will require a dramatic increase in cobalt production.

The booming demand for cobalt has a dark side, however. The Democratic Republic of Congo, one of Africa’s poorest nations, holds the lion’s share of the world’s cobalt reserves. In 2020, 70% of the world’s cobalt was extracted from within its borders with tens of thousands of workers labouring in large-scale industrial mines to dig up the ore. Multinational mining companies that own many of Congo’s mines, eager to demonstrate their “green” and “responsible” credentials, say they produce “clean” and “sustainable” cobalt, free from human rights abuses, and that their operations contribute to good jobs and economic opportunities.

This report, based on extensive research over two years, paints a very different picture. It shows dire conditions for many Congolese workers in the industrial mines, often characterised by widespread exploitation and labour rights abuses. Many workers do not earn a “living wage” – the minimum remuneration to afford a decent standard of living – have little or no health provision, and far too often are subjected to excessive working hours, unsafe working conditions, degrading treatment, discrimination and racism.

In recent years attention has mainly focused on Congo’s artisanal mining sector, partly because of the risks of child labour it creates, whereas the conditions for workers in the large-scale industrial mines have gone largely unnoticed. This report examines workers’ rights at Congo’s industrial mines where the large majority of cobalt is coming from, producing some 80% of the cobalt exported from the country (in contrast to the 20% produced in artisanal mines).

The findings presented in this report are based on detailed research over 28 months by UK-based corporate watchdog Rights and Accountability in Development (RAID) and the Centre d’Aide Juridico- Judiciaire (CAJJ), a Congolese legal aid centre specialised in labour rights. The research team carried out extensive field research in and around Kolwezi, a mining town where many of Congo’s cobalt and copper mines are located. It is informed by 130 interviews of workers and former workers at five mining companies, as well as interviews with subcontractors, union representatives, lawyers, Congolese local authorities, medical staff and industry experts.

Voodoo Employees Wrongly Fired During June Heat Wave, Labor Board Rules

The fired employees will get their jobs back and receive back pay for the three months they were unemployed at the Old Town doughnut shop.

Seven Voodoo Doughnut employees who were fired after walking off the job during the record-breaking June heat wave were wrongly terminated, the National Labor Relations Board ruled on Oct. 6.

The board ordered that Voodoo rehire the employees and offer back pay for the more than three months they weren’t employed at the Old Town doughnut shop.

Voodoo Doughnut’s corporate office did not respond to a request for comment.

A majority of the Old Town location’s employees walked out of the shop during the 116-degree heat wave that blanketed Portland in late June. Employees at the time told WW that temperatures inside the shop swelled to even higher than the outside temperature, and that the presence of deep fryers exacerbated the stifling heat.

“Attempts to provide relief, such as Gatorade and wet towels, are insufficient and the current air-conditioning system is not up to the task of dealing with this heat wave,” a Doughnut Workers United representative said at the time. “No person should work in temperatures in excess of 90 degrees. Other establishments have taken the reasonable step of closing during this time while Voodoo Doughnut, with its large southwest-facing windows and deep fryers, has not.”

After walking out, seven employees were fired on the allegation of workplace abandonment.

The National Labor Relations Board also deemed that the company partook in inappropriate conduct by surveying its employees’ support for a union drive.

We tried to transition to green jobs, but the bosses are closing our car factory down

More than 500 workers, myself included, at the GKN Automotive factory in Birmingham have voted for strike action to save both our plant and British manufacturing. It’s the last thing we ever wanted to do, but we feel we have been left with no choice.

Currently, we manufacture and assemble components for drivelines, the all-important section underneath your car for transferring power from the engine and transmission to the wheels. In 2019, 90% of GKN’s components went into traditional combustion engines, but that may halve by 2025, with electric vehicles (EVs) taking 15% of components, and hybrids about 40%. The move to electric will only continue, as UK factories unveil their new vehicle plans before purely internal combustion engines are banned in 2030.

In order to future-proof our jobs and the British automotive industry, we need to transition to producing components for EVs, including new propulsion systems and e-drives. GKN has developed a new e-drive with UK government funding at its Oxfordshire research facility, but sadly we won’t see this innovation creating new green jobs for British workers. Melrose, the owners of GKN, have decided to close our plant in 2022 and move jobs overseas.

We realised that if we want to see a green future for the UK car industry and save our skilled jobs, we couldn’t leave it to our bosses and had to take matters into our own hands. We put together a 90-page alternative plan detailing how we could reorganise production to save money and make these new components.

Ours is the first transition plan for an automotive plant proposed by union stewards in the UK, and an echo of the 1976 Lucas Plan, when shop stewards at Lucas Aerospace, also in Birmingham, proposed converting their plant to socially useful products.

Now, as then, our alternative plan proposed saving jobs in Birmingham while transitioning the plant into an asset to support the wider UK industry. That’s a win for the workforce, the industry and the environment. If that isn’t what’s meant by the phrase “just transition”, I don’t know what is.

Washington Carpenter Revolt Swells Picket Lines

Two thousand Washington carpenters went on strike yesterday, out of 6,600 who currently work under the master agreement with the Association of General Contractors (AGC). Five jobs were picketed, including construction projects at Facebook’s Building X, the Microsoft’s Campus in Redmond, and Alphabet’s Google.

“I didn’t know what to expect. People can talk on Facebook, but you don’t know until it’s time for people to show up,” said Joe Rice, a general foreman at Local 30.

Local 816 carpenter Bryce Owings was required to report to work, but he took the day off to stand on the picket line. “I’m a card-carrying carpenter” before anything else, said his superintendent at the jobsite, when Owings asked for a personal day to stand on the picket line.

“This is the beautiful part—now the membership is taking their union leadership and guiding them in the right direction,” said Jimmy Castillo Matta, Jr., a delegate in Local 41, who spent his 25th birthday on the picket line.

The support has also come from other trades. “The fight they’re having, we’re all facing. The AGC isn’t stupid,” said H.M., a member of Operating Engineers Local 612 who asked to use only her initials.

One Million Rounds: The Battle of Blair Mountain

When you think of violent labor disputes, which come to mind? For some, it may be the infamous 1886 Haymarket Affair, 1912 Lawrence textile strike (famously known as Bread & Roses), 1894 Pullman Strike, or something as modern as the 1991 Justice for Janitors police riot. But not many will recall the Battle of Blair Mountain, a week-long civil war that took place in West Virginia during the late summer of 1921. Some 13,000 mineworkers took on 3,000 law enforcement officials, military personnel, and the usual local scabs. Rather than take oppression sitting down, these miners put on their hard hats and geared up for war. However, despite the numbers, the miners suffered a crushing defeat and what resulted was the near collapse of the United Mineworkers of America. But how did it all begin?

In the spring of 1912, West Virginian mineworkers, who all lived in small towns near their respective coal fields, attempted to negotiate contracts with the mining companies to give them higher pay raises and union dues that would be automatic. As you might expect, negotiations fell through, resulting in 7,500 workers going on strike throughout West Virginia. Even local supporters who were not mineworkers joined in. This caught the unwanted attention of the Baldwin-Felts Detective Agency, a private police force that was called to the task of using brutality, fear, and intimidation to break up strikes. To really send the message, the agents began evicting miners from their homes, for unionizing with the UMWA.

Eventually, Mary Harris “Mother” Jones, co-founder of the revolutionary Industrial Workers of the World, joined the strikers, but was later arrested for her involvement in the Paint Creek-Cabin Creek strike of 1912. In the early months of the year-long said strike, the miners issued their own declaration of war against the West Virginian government. Several instances of guerilla-style conflicts began to explode in Kanawha County, WV. Things got so bad that WV Governor William E. Glasscock placed the region under martial law. After a year of bloody combat, more than 50 people were reported dead. The Paint Creek-Creek Cabin strike was the beginning of a 9-year labor conflict, now famously referred to as the West Virginia Mine Wars.

Fast-forward to 1920. The Baldwin-Felts agents were at it again, ransacking homes and evicting miners and their families at the Pocahontas Coalfield in the town of Matewan in Mingo County, West Virginia. This time around, they came face to face with Sid Hatfield, the Matewan police chief and beloved labor organizer. Unlike the vast majority of cops in West Virginia, Chief Hatfield was very outspokenly pro-union, using his position of authority to protect striking workers. He confronted the Baldwin-Felts agents and threatened to arrest them, prompting the agents to brag about their own arrest warrants against Hatfield.

Over the years, the circumstances of what happened next have been debated, but according to official court transcripts published in David Alan Corbin’s Gun Thugs, Rednecks & Radicals: A Documentary History of the West Virginia Mine Wars, an eyewitness testified that Cabell Testerman, the mayor of Matewan, said outright that the detectives’ warrants were “bogus,” triggering an angry Albert Felts, one of the heads of the Baldwin-Felts agency, to pull a firearm from his briefcase and shoot the mayor, who died of his wounds minutes later. Immediately after, Hatfield began firing, and a firefight between him and the agents ensued. When the dust settled, one miner, an innocent bystander, seven Baldwin-Felts agents and Mayor Testerman lay dead, while several other townsfolk were wounded in the crossfire.
